1.     What is personal information?

Personal Information” is information or an opinion about an identified individual, or an individual who is reasonably identifiable, (a) whether the information or opinion is true or not; and (b) whether the information or opinion is recorded in a material form or not.

Sensitive Information” is Personal Information that includes health information, genetic information, or information or an opinion about an individual’s racial or ethnic origin, political opinions, membership of a political association, religious beliefs or affiliations, philosophical beliefs, membership of a professional or trade association, memberships of a trade unition, sexual preferences or practices or criminal record. This information can only be collected with consent.

The type of Personal Information we collect, and use, will depend on various factors such as the type of service request you make and any applicable legal and regulatory obligations. Examples may include, but are not limited to, the following kinds of information:

Work contact information (i.e. email address (sometimes personal), phone number and postal address)

We collect Personal Information directly from you in a range of settings. We do this in ways including but not limited to:

·       When you engage with us or request information about us, our products or services (via telephone, email, Website, post or in person)

·       If you contact us through social media (i.e. LinkedIn)

·       When you enter into an agreement or contract with us

·       When you engage with us in the course of delivering a project

·       If you attend events such as lunch time workshops, seminars or online webinars

·       If you subscribe to Impactful Work’s online services including newsletter, insights or webinars

·       If you provide feedback via forms and/or surveys

·       If you apply for a position with us (for example, as an employee or contactor) or a student placement

We may also collect Personal Information about you via third parties including from our clients, through events, online marketing or online services (i.e., LinkedIn). In such instances where Personal Information is provided by external clients, we will treat this in accordance with the Privacy Act.

This Privacy Policy governs how we use, collect or disclose Personal Information provided on our Website. By using the Website you agree to the terms and conditions contacted in this Privacy Policy.

4.1.  Why do we collect, hold and use Personal Information about you?

We collect information about you to enable us to perform our business activities and functions, and to provide the best possible quality customer experience. We collect, hold and use personal information for reasons including the following (this list is not exhaustive):

·      to enter into a contract with you to provide you with the products and services you have requested

·      to provide you with ongoing news and information about us, our activities, existing and new products and services [you will be able to unsubscribe from advertising and marketing at any time]

·      to offer additional benefits to you (I.e. inviting you to events, webinars and to access key insights and resources)

·      to enable you to access password protected areas of our Website

·      for personalising and customising your experience with us

·      for internal record keeping and administrative purposes

·      for managing and enhancing our products and services

·      to deliver our consulting services to our clients

·      to use de-identified information for the purposes of data analysis, research and reporting

We may use your Personal Information for Direct Marketing (i.e. newsletter and events subscription) which is permission-based. If you have received an email from us, our records will indicate that you have shared this address for receiving updated information from us. Your information will not be used for any other purpose than correspondence between you and Impactful Work. For emails that are subscription based, you can unsubscribe at any time by clicking the “unsubscribe” link in the footer of the email.

4.2.  What happens if you don’t provide personal information?

If you do not provide the Personal Information that Impactful Work requests, we may be limited in our ability to provide our products and services to you.

5.     Disclosure of Personal Information

5.1.  In what circumstances do we disclose your Personal Information?

Your personal information may be disclosed to external organisations under any one or more of the following circumstances:

·       third party service providers (with your consent), including agents or sub-contractors who may assist us in providing information, products or services including:

o   competency or psychometric tests and assessments

o   data storage and archiving

o   information technology and other software and systems

o   advertising or marketing agencies

·       providing information to government authorities, as required or authorised by law

·       where there is a legal obligation to do so (including the Privacy Act)

·       if we need to enact Duty of Care obligations (e.g., if there is the immediate and specified risk of harm to an identifiable person or persons that can be averted only by disclosing information).

If Impactful Work engages external service providers, Impactful Work will take steps – where possible – to ensure providers:

·      comply with the APPs and Privacy Act 1988

·      use Personal Information only for the limited purposes specified to them.

Impactful Work is also bound by professional obligations of confidentiality, including in relation to personal information.

6.     Correction and Access of Personal Information

Under the Privacy Act, you have the right to update, correct and access your Personal Information.

6.1.  How do you update and correct your Personal Information?

Impactful Work has accurate information about you, so as to provide you with the best possible service. If you believe that the Personal Information we hold about you is incorrect, incomplete, irrelevant or inaccurate, then you may request us to amend it by contacting a Privacy Officer via info@impactful.work. We request that you keep your information as current as possible.

6.2.  How do you access your Personal Information?

You have a right to access your personal information held by Impactful Work, subject to the exceptions listed in the Privacy Act. If you would like to do so, please contact the Privacy Officer. Your request may need to be put in writing for security purposes and you will need to provide proof of identity.

Impactful Work can provide you with a copy of the relevant personal information via electronic print-out or a photocopy at no charge. If we decline a request for access to information, we will tell you why (i.e. if it would interfere with the privacy of others or if it would result in a breach of confidentiality).

7.     Data Security and Storage of Personal Information

7.1.  How do we secure your Personal Information?

Impactful Work is committed to ensuring that all Personal Information we collect is secure. We have physical, electronic and managerial procedures to safeguard and protect the Personal Information we hold against loss, misuse, interference or unauthorised access, modification and disclosure. All personal information is be stored securely in locked filing cabinets, encrypted information technology systems or password protected computer files.

We cannot guarantee the security of any information that is transmitted to us over the Internet. The transmission and exchange of information to us is entirely at your own risk. 

However, except to the extent that statutory liability cannot be excluded, we exclude all liability (including in negligence) for the consequences of any unauthorised access to, disclosure of, misuse of or loss or corruption of your personal information. Nothing in this Privacy Policy restricts, excludes or modifies any statutory consumer rights under any applicable law (including the Competition and Consumer Act 2010 (C’th)).

Additionally, as a condition of employment, all employees, contractors and placement students are to treat Personal Information as confidential. We agree to take reasonable steps to secure information and ensure nothing is disclosed in a manner that is inconsistent with this Privacy Policy.

7.2.  How do we store your Personal Information?

Information will be kept for a minimum of seven years as required by law for psychologists. It may be kept longer for business purposes. When no longer required, we will take steps to destroy or de-identify your Personal Information.

8.     Changes to our Privacy Policy

We may review and update this Privacy Policy including to consider new laws, regulations and technologies. All personal information held by us will be governed by our most recent Privacy Policy, as posted on our website www.impactful.work (Website). Our most recent Privacy Policy will apply to how we collect, use, and disclose Personal Information.
